Delaware Commercial Feed Law

This act regulates the manufacture, distribution, and sale of commercial animal feeds and pet foods. It requires distributors to obtain and maintain a license, to file periodic tonnage reports and pay inspection fees on the feed they sell, and to label their products — including feeds mixed to a customer's formula — with prescribed information, while prohibiting the distribution of feed that is adulterated (by poisonous or deleterious substances, unsafe additives or drugs, pesticide residues, weed seed, or a failure to meet its own label claims) or misbranded. Enforcement rests with the state agriculture department, which promulgates implementing rules, inspects premises and records, samples and analyzes feed, and may withdraw feed from distribution, seize and dispose of violative products, or refuse or cancel a license — subject to hearings and judicial review.
