Overview

This act governs notarial acts and the commissioning of the notaries public who perform them. It identifies whose notarizations are recognized — acts performed within the state as well as those taken in other states, under the authority of a federally recognized Indian tribe, under federal authority, or in a foreign jurisdiction — and prescribes the mechanics of a valid act: personal appearance, identification of the individual, the certificate and short-form certificates, the official stamp and stamping device, and the notary's authority to refuse to act. It also sets qualifications and grounds to deny, suspend, or revoke a commission, authorizes notarization of electronic records and of acts for remotely located individuals, and backs the scheme with maximum fees, prohibited acts, notary and employer liability, criminal penalties, and administrative complaint and investigation procedures.
