Held: the effect of the statute as it stood prior to the amendment of 1936 was to make the license privilege a form of protection against damage to the public inflicted through the licensee’s carelessness. 7 *37 Second.

Held: the bailee of goods who' has not assumed a common carrier’s obligation is not an insurer. His undertaking is to exercise due care in the protection of the goods committed to his care and to perform the obligation of his contract including the warranty of seaworthiness when he is a shipowner.

Edwards v. People of State of California, 314 U.S. 160 (1941), was a landmark United States Supreme Court case where a California law prohibiting the bringing of a non-resident "indigent person" into the state was struck down as unconstitutional.

Lisenba v. California, 314 U.S. 219 (1941), was a case in which the United States Supreme Court upheld the criminal conviction and death sentence imposed upon a man who confessed to murder after being detained for more than 24 hours, slapped and deprived of sleep and food. The petitioner argued that the confession was coerced, and that it violated his due process rights under the Fourteenth Amendment to the U.S. Constitution.

United States v. Santa Fe Pacific Railroad Co., 314 U.S. 339 (1941), is a United States Supreme Court case in which the Court held that the power of Congress to extinguish aboriginal title is plenary and nonjusticiable but that Congress was presumed not to do so absent a clear intention. It is the leading precedent on the extinguishment of aboriginal title in the United States.

Held: however, “as *447 matter of law/’ that on December 31, 1939, the last day of the taxable year, petitioner was not domiciled in the District of Columbia, believing that it was compelled to do so by the decision of the United States Court of Appeals for the District of Columbia in Sweeney v. District of Columbia, 72 App. D. C. 30 , 113 F. 2d 25 , certiorari denied, 310 U. S. 631 .

Morton Salt Co. v. G.S. Suppiger Co., 314 U.S. 488 (1942), is a patent misuse decision of the United States Supreme Court. It was the first case in which the Court expressly labeled as "misuse" the Motion Picture Patent/Carbice tie-in defense to a charge of patent infringement and created the present blanket remedy in infringement cases of unenforceability of the misused patent. The decision re-emphasized that misuse can be found without finding an antitrust violation.

B.B. Chemical Co. v. Ellis, 314 U.S. 495 (1942), is a United States Supreme Court decision involving the patent misuse doctrine and the extent of remedies a court should award after finding a misuse that the patentee alleges it has now discontinued. The Court ruled that to be able to enforce the patent against infringement the patentee must show that it has fully abandoned its unlawful practice and that the consequences of that practice have been fully dissipated. This was a companion case to Morton Salt Co. v. G.S. Suppiger Co. decided on the same day.

Held: that although the sale of the gas and its movement into the state is interstate commerce, that commerce comes to an end when appellant reduces the gas pressure before its delivery into the service pipes of the distributors. .

Held: and on the basis of a huge record of some 53,000 pages of testimony, including 2,100 exhibits, 20,000 pages of memoranda, exceptions, and oral arguments, the Commission on July 1, 1930, issued a report and order prescribing maximum rates for grain and grain products. 164 I. C. C. 619 . A supplemental report and order were issued on April *537 13, 1931. 173 I. C. C. 511 .

Held: however, that “A wife cannot by agreement make the husband's right created by law immune from the right of the State to change the law which created the right nor waive in advance a right created for her benefit if tire law does not permit such a waiver.” Section 18 was held to confer a right of election upon Helena, and to be consistent with the requirements of the contract and due process clauses of the Federal…
