<bold>[1] Vendor and Purchaser — Homestead — Vendor's Lien — Judgment</bold> <bold>for Transfer of Realty.</bold> A judgment for the purchase price of realty is a vendor's lien for purposes of RCW 6.12.100, which permits the enforcement of a vendor's lien against a homestead, even though no documents of conveyance are executed or delivered. <bold>[2] Vendor and Purchaser — Conveyance — What Constitutes —</bold> <bold>Release of Vendee's Interest.</bold> The interest of a purchaser under a real estate contract is real property, and the purchaser becomes a vendor in releasing or transferring such interest back to the original seller. <bold>[1] States — Statutes — Conflict With Federal Law — Preemption —</bold> <bold>Determination.</bold> A federal enactment will preempt state statutes and common law if the federal statute clearly evinces a congressional intent to preempt or if the federal act so directly and positively conflicts with state law that they are irreconcilable. A strong presumption exists against congressional intent to preempt, and a finding of such intent must be based on an unambiguous congressional mandate to that effect. <bold>[2] Banks and Banking — National Banking Act — Preemption of</bold> <bold>State Law — Determination.</bold> State laws affecting national banks are preempted by the National Banking Act (12 U.S.C. ch. 2) if the state laws interfere with the purpose of the banks, impair their efficiency as federal agencies, or conflict with the act itself. <bold>[3] Banks and Banking — Trade Names — Similar Names of Banking</bold> <bold>Institutions — Federal Preemption.</bold> The authority given to the Comptroller of the Currency by the National Banking Act to approve the names of national banks includes consideration of name confusion, and preempts state laws concerning the unfair use of trade names to the extent that an actual conflict in the laws exists, <italic>viz.</italic>, the actual name and its general use as opposed to logos or symbols based on the name. <bold>[4] Trade Names — Different Market Areas — Effect.</bold> Trade name protection is limited to the extent of competition in a given market area. <bold>[5] Trade Names — Federal Trademark Act — State Jurisdiction.</bold> State courts have concurrent jurisdiction to decide actions under the federal trademark act, 15 U.S.C. ch. 22.
