Identity theft law addresses the unauthorized use of another person's personal information — such as Social Security numbers, credit card details, or account credentials — to commit fraud or other crimes. It sits at the intersection of criminal law and consumer protection, covering both the prosecution of perpetrators and the rights of victims who must untangle the damage left behind.

Common situations this area of law involves include fraudulent credit accounts opened in a victim's name, tax refunds claimed by imposters, medical services billed to someone else's insurance, and takeovers of existing bank or investment accounts. Victims typically face a combination of financial loss, damaged credit, and a lengthy process of disputing fraudulent records with creditors, credit bureaus, and government agencies.

Federal statutes — including the Identity Theft Enforcement and Restitution Act and provisions of the Fair Credit Reporting Act — establish baseline protections and criminal penalties. However, specific remedies, victim-assistance programs, and enforcement priorities vary considerably from state to state and continue to evolve as technology changes.
