In establishing order and subdivisions of layoff and reemployment, the board, when it finds past discriminatory hiring practices, may authorize modification of the order of layoff, in accordance with board rule, only if failure to do so by a department would result in ineligibility for a federal program with a loss of federal funds or if required by federal law or the United States Constitution.
