N.Y. Correct. Law § 147

§ 147. Alien incarcerated individuals of correctional facilities. The\ncommissioner shall within three months after admission of an alien\nincarcerated individual to a correctional facility cause an\ninvestigation to be made of the record and past history of such alien\nand shall upon the termination of such investigation cause the record of\nsuch alien, together with all facts disclosed by such investigation, and\nhis or her recommendations as to deportation, to be forwarded to the\nUnited States immigration authorities having such matters in charge.\n
