Divorce law governs the legal process of ending a marriage. Beyond formally dissolving the marital relationship, it resolves the practical questions that come with separation, including property, finances, and arrangements for any children.

A divorce typically addresses several connected issues: dividing property and debts accumulated during the marriage, deciding whether one spouse will provide financial support to the other, and, when children are involved, establishing custody and child support. Some divorces are largely uncontested, with the spouses agreeing on most terms, while others are contested and require more involvement from the court.

Key concepts a non-lawyer should understand include the distinction between fault and no-fault grounds for divorce, the difference between marital property acquired during the marriage and separate property, and the idea that spousal support and property division are decided on factors that vary widely by location. Many divorces are resolved through a negotiated settlement rather than a trial, sometimes with the help of mediation.

People typically consult a divorce lawyer when a marriage is ending, especially when there are children, significant assets or debts, a business, or disagreement over key terms. Legal guidance helps a person understand their rights and the issues a divorce must resolve.
