Paternity law governs the legal establishment of who is recognized as a child's father. While biological fatherhood is a fact, legal fatherhood is a status that must be formally established — and it carries significant consequences for child support, custody, inheritance rights, access to a father's health insurance, and eligibility for benefits such as Social Security survivor payments.

Common situations that bring people into contact with paternity law include unmarried couples disputing whether a man is a child's biological father, a mother seeking child support from a man who denies paternity, a man who wants to assert parental rights to a child he believes is his, and cases where a presumed father — typically a woman's husband at the time of birth — seeks to challenge or confirm his legal status. DNA testing has become the standard tool for resolving biological questions, but the legal process for acting on those results varies considerably.

Paternity can be established voluntarily, through a signed acknowledgment at birth, or through a court order following a legal proceeding. Once established, it creates mutual rights and obligations between parent and child. The specific procedures, timelines, and legal standards differ from state to state and may change as legislatures update family law statutes.
