Child Custody Law

Child custody law governs how parents or guardians share responsibility for raising a child when they do not live together. It addresses both where the child lives and who makes important decisions about the child's life.

Custody questions arise during divorce or separation, between parents who were never married, and sometimes in disputes involving other relatives or guardians. The law generally distinguishes between two ideas: where the child primarily resides and spends time, and who has authority over major decisions such as education, health care, and religious upbringing. These can be shared between parents or assigned primarily to one.

The central principle a non-lawyer should understand is the 'best interests of the child' standard, which guides every custody decision. Courts consider factors such as stability, each parent's relationship with the child, and the child's needs, rather than simply favoring one parent. Custody arrangements are often set out in a parenting plan, and they can usually be changed later if circumstances meaningfully change.

People typically consult a child custody lawyer when separating from a co-parent, when parents cannot agree on a parenting arrangement, when they wish to modify an existing order, or when they are concerned about a child's safety or well-being. Legal guidance helps a parent understand how custody decisions are made.
