(a) The Secretary shall transmit a report to the Congress not later than January 1, 1971, and annually thereafter, concerning (1) current information in the health consequences of smoking, and (2) such recommendations for legislation as he may deem appropriate.

(b) The Federal Trade Commission shall transmit a report to the Congress not later than January 1, 1971, and annually thereafter, concerning (1) current practices and methods of cigarette advertising and promotion, and (2) such recommendations for legislation as it may deem appropriate.

Amendments

1984—Subsec. (a). Pub. L. 98–474, §6(d)(1), (2), substituted “Secretary” for “Secretary of Health, Education, and Welfare” and redesignated cls. (A) and (B) as pars. (1) and (2), respectively.

Subsec. (b). Pub. L. 98–474, §6(d)(3), struck out cl. (A) “the effectiveness of cigarette labeling,” and redesignated cls. (B) and (C) as pars. (1) and (2), respectively.

1970—Pub. L. 91–222 substituted provisions requiring the Secretary of Health, Education, and Welfare, and the Federal Trade Commission, respectively, to transmit a report to Congress, at the prescribed time, concerning current information in the health consequences of smoking, and such recommendations for legislation as he may deem appropriate, and the effectiveness of cigarette labeling, current practices and methods of cigarette advertising and promotion, and such recommendations as it may deem appropriate, for a provision exempting cigarettes for export from the requirements of this chapter. See section 1340 of this title.

Effective Date of 1970 Amendment

Amendment by Pub. L. 91–222 effective Jan. 1, 1970, except where otherwise specified, see section 3 of Pub. L. 91–222, set out in part as a note under section 1331 of this title.
