The plaintiff, John Rocchio Corporation, appealed a Providence County Superior Court judgment granting the defendant, Pare Engineering Corporation's motion for summary judgment, based on the plaintiff's failure to establish causation. The plaintiff asserted on appeal that causation is a question for a trier of fact and not proper grounds for summary judgment. The Supreme Court affirmed the hearing justice's grant of the defendant's motion for summary judgment, albeit on different grounds. The Supreme Court held that the plaintiff's negligence claim failed for lack of a duty owed to the plaintiff by the defendant, and further held that summary judgment was appropriate on the plaintiff's remaining claims for intentional interference with prospective contractual relations and breach of contractual obligations to a third-party beneficiary. Accordingly, the Court affirmed the judgment of the Superior Court.
